The Humanitarian and Compassionate certificate is for candidates who are in Canada and would experience excessive difficulty if they were extradited to their home country concerning social, economic or personal reasons. Individuals who would not be usually likely to achieve perpetual residency in Canada, they can use humanitarian and compassionate grounds.

Refugees are individuals who are obliged to leave their home country due to a concern of abuse and are not able to return home. Canada’s refugee system allows refugees with other rights to register for their permanent residency under humanitarian and compassionate grounds. These requests can be classified into two categories:

  • Resettlement from outside Canada
  • Claiming refugee protection from inside Canada
The United Nations Refugee Agency (UNHCR), and by private sponsors, decides refugees for resettlement. No one is permitted to directly apply to Canada for resettlement. Besides, private sponsors across Canada are accommodating in resettlement of refugees to Canada. For this, they have contracts with Canadian administration for helping refugees. These organisations are called Sponsorship Agreement Holders and allow sponsorship to refugees on their personal or cooperate with others for doing so.
This program assists in granting refugee security to persons in Canada having—
  • A definite concern of getting persecuted
  • A prospect of torture/unusual suffering in their respective home nations.

Following individuals are not qualified for asylum claims—

  • Having former refugee claims not approved by Canada
  • Convicted of any serious criminal assault
